[FOR MINORS PARTICIPATING IN EVENTS AND/OR TRAINING AT FACILITIES WITH DYNAMIC ATHLETIC PERFORMANCE, LLC]
In the event of an emergency where I (or my spouse or other guardian) cannot be contacted, I authorize Dynamic Athletic Performance to secure whatever medical care is necessary for the safety and well-being of my child. I will assume all costs incurred for emergency care.
PLEASE READ THIS AGREEMENT AND RELEASE CAREFULLY. BY FILLING OUT THE INFORMATION AND SIGNING BELOW, YOU AGREE TO ALL THE TERMS AND CONDITIONS IN THIS AGREEMENT AND CERTIFY THAT YOU HAVE READ THE ENTIRE AGREEMENT.
Release of Liability and Assumption of Risk
I understand and expressly agree that my use of Dynamic Athletic Performance, or any other Dynamic Athletic Performance facility, involves the risk of injury to me, my child, or my guest whether caused by me or not. I understand that these risks can range from minor injuries to major injuries including death. In consideration of my participation in the activities and/or my child’s participation, and use of the facilities, exercise equipment or services offered by Dynamic Athletic Performance, I understand and voluntarily accept fully responsibility on my behalf and on my guest’s and/or my child’s behalf for the risk of injury or loss arising out of related to the use of facilities, exercise equipment or participation in exercise programs or other services.
I further agree that Dynamic Athletic Performance, its affiliated companies and their respective officers, directors, employees, members, agents and independent contractors (collectively “Dynamic Athletic Performance”) will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, disability, death, economic loss or any damage to me, my spouse or domestic partner, guests, children, unborn child, heirs or relatives resulting from the negligent conduct or omission of Dynamic Athletic Performance or anyone acting on Dynamic Athletic Performance’s behalf whether related to exercise or not. Accordingly, to the fullest extent permitted by law, I do hereby forever release, waive, and discharge Dynamic Athletic Performance from any and all claims, demands, injuries, damages, actions or causes of action against Dynamic Athletic Performance. I further understand and acknowledge that Dynamic Athletic Performance does not manufacture fitness or other equipment or products available in its facilities, but purchases and/or leases equipment and therefore, Dynamic Athletic Performance will not be held liable for defective equipment or products.
Dynamic Athletic Performance does not accept members under the age of eighteen (18). In exchange for Dynamic Athletic Performance allowing my minor child, who is younger than eighteen (18) years of age, to participate in activities and use of the facilities, exercise equipment, or services offered by Dynamic Athletic Performance, I agree to the Release of Liability and Assumption of Risk clauses in this agreement and I agree to defend and indemnify Dynamic Athletic Performance to the fullest extent permitted by the law for any claim brought by my minor child against Dynamic Athletic Performance. I also promise to pay any financial obligation that my minor does not pay for any reason and acknowledge that the banking information above is my account. If my minor child is attending, I understand and agree that my minor child that is under the age of eighteen (18), must be accompanied by a parent or guardian at all times while in the Dynamic Athletic Performance facility.
I promise to pay any financial obligation that the member does not pay for any reason and acknowledge that the banking information above is my account. I also agree to defend and indemnify Dynamic Athletic Performance to the fullest extent permitted by the law for any claim brought against Dynamic Athletic Performance by the member. I further promise to pay any financial obligation stemming from damage caused to the facility, equipment, and any other property of Dynamic Athletic Performance by myself or my child. I understand that Dynamic Athletic Performance has the sole discretion to determine the extent and cost of any such damage.
THE ABOVE LIABILITY AND ASSUMPTION OF RISK ALSO APPLIES TO ANY TRAINER, COMPANY OR RENTER USING THE DYNAMIC ATHLETIC PERFORMANCE FACILITY FOR TRAINING PURPOSES. IF YOU ARE A VISITOR TO THE DYNAMIC ATHLETIC PERFORMANCE AND/OR NOT PAYING DYNAMIC ATHLETIC PERFORMANCE DIRECTLY, PLEASE ACCEPT THIS LIABILITY WAIVER PRIOR TO ANY KIND OF TRAINING AT THE DYNAMIC ATHLETIC PERFORMANCE FACILITY.
